These Terms of Use (“Terms”) apply to your access to and use of the website, web application and services operated by Find My Therapy Pty Ltd (“Find My Therapy”, “we”, “us”, “our”).
By accessing or using our website or services, you agree to be bound by:
these Terms; and
our Privacy Policy.
If you do not agree, you must not use our website or services.
1.1 Find My Therapy is an online directory and information platform that helps people in Australia find and connect with allied health professionals (“Services”).
1.2 Our platform and any related content (including practitioner profiles, articles, guides, fact sheets, FAQs and other materials):
are provided for general information and educational purposes only;
are not medical, psychological, diagnostic, therapeutic or professional advice;
should not be relied on to diagnose, treat, cure or prevent any medical condition; and
are not an endorsement or recommendation of any particular practitioner, treatment, test, service or product.
1.3 You must always seek the advice of a doctor, psychologist or other appropriately qualified health professional regarding any medical or mental health condition, and never delay or disregard professional advice because of something you have read on Find My Therapy.
1.4 Your use of our website or services does not create any practitioner–patient, client–therapist or other clinical or fiduciary relationship with Find My Therapy.
1.5 If you think you may be experiencing a medical emergency or crisis, call 000 (in Australia) or seek immediate assistance from emergency services.
2.1 We may update these Terms from time to time by publishing the revised version on our website with a new “Last updated” date.
2.2 Your continued use of our website or services after changes take effect constitutes your acceptance of the updated Terms.
2.3 If we make a substantial change (a material change that reduces your rights or increases your responsibilities), we will use reasonable efforts to provide at least 14 days’ prior notice (for example, by email or a prominent notice on the website).
2.4 If you do not agree to any changes, you should stop using the website and services and, if you have an account, request that it be closed.
3.1 Our website and services are directed to individuals 18 years of age or older. If you are under 18, you must not use the website or services.
3.2 When you register for an account (for example, as a user or as a practitioner), you will be asked to provide certain information such as your name, email and password (“Credentials”). You agree that:
all information you provide is true, accurate, current and complete;
you will promptly update your details if they change;
you are not impersonating any person or entity; and
you are not violating any applicable law relating to identity or personal information.
3.3 You are responsible for:
maintaining the confidentiality of your Credentials;
all activity that occurs under your account; and
notifying us promptly if you suspect unauthorised access or a security breach.
3.4 We may, at our discretion, suspend or terminate any account if we reasonably believe that our brand, reputation, operations or other users may be harmed by the account or content associated with it, or if these Terms are breached.
This section applies to allied health professionals and clinics using Find My Therapy to list or promote services.
4.1 When you register as a practitioner or clinic, you represent and warrant that:
all information you provide (including qualifications, registration details, practice address, special interests and fees) is true, accurate and not misleading;
you hold, and will maintain, all registrations, licences, insurance and approvals required by law and your professional regulatory bodies;
you will promptly update your profile if any information becomes inaccurate or materially changes; and
your use of Find My Therapy will comply with all applicable laws, professional codes and advertising rules (including the Australian Consumer Law and any relevant health advertising requirements).
4.2 We may, at our discretion, verify some information (e.g. registration or membership with professional bodies) and may suspend, edit or remove a listing where we reasonably believe it is inaccurate, misleading, unlawful or inappropriate.
4.3 You remain solely responsible for:
your professional conduct;
the advice, treatment and services you provide; and
any clinical or contractual relationship between you and your patients or clients.
Find My Therapy does not employ, supervise or direct practitioners and is not responsible for the quality or outcome of any care you provide.
5.1 You agree to use our website and services only for lawful purposes and in accordance with these Terms.
5.2 You must not:
harass, threaten, abuse, defame or otherwise harm another person;
post or transmit any content that is false, misleading, obscene, hateful, discriminatory, pornographic or otherwise unlawful;
post testimonials or reviews that are not genuine or cannot be substantiated;
upload or distribute viruses, malware, harmful code or any other technology that may harm our systems or other users;
attempt to gain unauthorised access to any account, system or network;
use our website or services in a way that could damage, disable, overburden or impair them.
5.3 No spam: You must not use contact details obtained from Find My Therapy to send unsolicited bulk messages (spam or similar). We may suspend or terminate your account if we reasonably believe you have engaged in spam or related activity.
5.4 You are responsible for any use of the website or services under your Credentials, including use by others to whom you have given access.
6.1 You must not use any robot, spider, scraper, data-mining tool, or other automated means to access, monitor, copy or extract data from our website or services, without our prior written consent.
6.2 Standard search engine indexing and caching by recognised search engines is permitted.
7.1 You may be able to submit or post content on or via the website, including:
reviews, testimonials or ratings;
comments, messages or other text;
practitioner profile information;
images or other materials
(collectively, “User Content”).
7.2 You are solely responsible for your User Content and you must ensure that it:
is accurate, honest and not misleading;
does not infringe any copyright, trade mark, privacy or other rights of any person;
does not promote illegal or unsafe activities;
complies with applicable health and advertising laws (including requirements around testimonials, claims and endorsements);
is not unlawful, threatening, defamatory, obscene, harassing, hateful, racist, sexist, or otherwise objectionable.
7.3 You must not imply or state that your User Content is endorsed or approved by Find My Therapy.
7.4 By posting or submitting User Content, you grant Find My Therapy a worldwide, non-exclusive, royalty-free, fully paid, transferable and sublicensable licence to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform and display such content in connection with operating, promoting and improving Find My Therapy (including in search results, marketing materials and aggregated or anonymised datasets).
7.5 We may, but are not obliged to, monitor, review, edit or remove User Content at our discretion if we reasonably believe it breaches these Terms, is unlawful or may harm other users or our reputation.
8.1 Unless otherwise stated, Find My Therapy (or its licensors) owns all rights, title and interest in:
the website and web app;
software, design, layout and “look and feel”;
our logos, trade marks and branding; and
original content created by or for Find My Therapy.
8.2 Subject to these Terms, we grant you a limited, revocable, non-transferable licence to access and use the website for your personal, non-commercial use (or, if you are a practitioner, for your legitimate business presence on the platform).
8.3 You must not, without our prior written consent:
reproduce, modify, adapt, translate, distribute, sell or exploit any part of the website or content for commercial purposes (other than as allowed for your own listing as a practitioner);
frame or mirror any part of the website;
scrape or systematically download content or data.
9.1 Our website may include links or integrations with third-party websites, tools or services (for example, booking systems, payment gateways or social media platforms).
9.2 These are provided for convenience only. We do not control, endorse or accept responsibility for:
the content, policies or practices of third-party sites; or
any products or services offered by third parties.
9.3 Your use of third-party sites is at your own risk and subject to their terms and privacy policies.
10.1 We handle personal information in accordance with our Privacy Policy, which forms part of these Terms.
10.2 By using our website or services, you consent to our collection, use and disclosure of your personal information as described in our Privacy Policy.
11.1 From time to time, we may run competitions, promotions or offer additional services. These may be subject to separate terms and conditions, which will apply in addition to these Terms.
11.2 If there is any inconsistency between these Terms and the specific terms of a promotion or competition, the specific terms will prevail to the extent of the inconsistency.
12.1 Find My Therapy is designed for and intended for users in Australia.
12.2 We make no representation that the website or services are appropriate or available for use in other locations. If you access the website from outside Australia, you do so at your own risk and are responsible for compliance with local laws.
13.1 We take reasonable steps to secure our website and systems. However, you acknowledge that:
the internet is not completely secure;
information sent to or from the website may be intercepted, altered or corrupted;
downloaded material may contain viruses or other harmful code.
13.2 We are not responsible for any loss or damage caused by malicious code, cyber attacks or other security vulnerabilities beyond our reasonable control. You are responsible for implementing your own virus protection, firewalls and security measures.
14.1 To the maximum extent permitted by law, the website, services and all content are provided on an “as is”, “as available” and “with all faults” basis.
14.2 We do not guarantee that:
the website or services will be uninterrupted, secure, timely or error-free;
any defects will be corrected;
information on the website is complete, current, accurate or suitable for your purposes;
any particular practitioner, service, product or treatment is safe, appropriate or effective for you.
14.3 We do not guarantee that you will be able to access the website at all times or from all locations.
14.4 No oral or written information or advice given by Find My Therapy creates any warranty not expressly stated in these Terms.
Nothing in these Terms excludes or restricts any consumer guarantees that cannot be excluded under the Australian Consumer Law.
15.1 To the extent permitted by law, and subject to any non-excludable rights under the Australian Consumer Law:
our maximum aggregate liability to you for any loss or damage arising out of or in connection with the website, services or these Terms is limited to the amount you have paid to us (if any) for the relevant service in the 12 months before the claim arose; and
we are not liable for any indirect, incidental, special or consequential loss, loss of profit, loss of opportunity, loss of goodwill or loss of data.
15.2 Your sole and exclusive remedy for dissatisfaction with the website or services is to stop using them and, if applicable, request closure of your account.
16.1 To the maximum extent permitted by law, you agree to indemnify and hold harmless Find My Therapy, its directors, officers, employees, contractors and agents from and against any claims, liabilities, damages, losses, costs and expenses (including reasonable legal fees) arising out of or in connection with:
your breach of these Terms;
your misuse of the website or services;
your User Content;
for practitioners, any breach of professional, legal or regulatory obligations in your provision of services to clients.
16.2 We may assume control of the defence of any matter subject to indemnification by you, in which case you agree to cooperate with us.
17.1 We may suspend or terminate your access to all or part of the website or services at any time, with or without notice, if we reasonably believe that:
you have breached these Terms or any applicable law;
your account has been used for unlawful or fraudulent activity; or
your continued use may harm other users or our reputation.
17.2 You may cease using the website at any time and may request deletion of your account.
17.3 On termination, your right to access the website and services ends. We may retain certain information where required by law or for legitimate business purposes (for example, to comply with legal obligations or resolve disputes).
18.1 By using the website or registering an account, you consent to:
these Terms being formed electronically; and
receiving communications from us electronically (for example, by email, via your account or via notices on the website).
18.2 Notices are deemed to be received:
24 hours after we send an email to the address associated with your account; or
when posted on the website or shown within your account.
If you do not wish to receive certain communications, you may adjust your preferences or close your account, but we may still send you important service or legal notices.
19.1 All trade marks, logos and branding displayed on the website are the property of Find My Therapy or their respective owners.
19.2 Nothing in these Terms gives you any right, licence or interest in any trade mark, logo or branding owned or used by Find My Therapy.
20.1 You and Find My Therapy are independent contractors. These Terms do not create any partnership, joint venture, employment, agency or fiduciary relationship.
20.2 Find My Therapy does not act as agent for practitioners and is not responsible for their professional conduct.
21.1 You must not assign or transfer your rights or obligations under these Terms without our prior written consent.
21.2 We may assign or transfer our rights and obligations under these Terms (in whole or in part), including in connection with a merger, acquisition or sale of assets, without your consent.
22.1 These Terms are governed by the laws of New South Wales, Australia.
22.2 You submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.
23.1 If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.
23.2 A failure or delay by us to exercise any right or remedy does not constitute a waiver of that right or remedy.
23.3 Headings are for convenience only and do not affect interpretation.
23.4 References to “including” and “includes” are not words of limitation.
